Benjamin J. H. Gaines, ex-judge of the county court of Sebastian County, [p.1317] Ark., is a native of Rhea County, East Tenn., and was born in 1817. His father, James S. Gaines, was of Welsh descent, and was born in Culpeper County, Va., in 1767.
He was married in his native State to Miss Judith Easley, and after a short residence in North Carolina returned to Virginia, and in 1800 moved to Rhea County, Tenn., and in 1820 took up his abode in Southern Alabama, where he died two years later. His wife was born in Virginia, and also died in 1822.
Benjamin J. H. is the youngest of their thirteen children, and was only five years old when his parents died. From that time until he was sixteen years of age he resided with his brother, John S. Gaines, and then became salesman in a store in Knoxville, Tenn., but at the end of one year returned to Southern Alabama, and engaged in pedagoguing, and also did some clerking in the courts.
From 1839 to 1840 he taught school in the "Lone Star" State, and at the latter date returned to Alabama, and was married in 1848 to Miss Sallie Inge, who was born in Fayetteville, Lincoln Co., Tenn., in 1827, by whom he became the father of four children: Helen, wife of J. L. Duke, a jeweler of Fayetteville, Ark.; Thomas W., a merchant; Marshall S., a merchant, of Greenwood, Ark.; and John H., who clerks for his brother, Marshall.
In 1849 Mr. Gaines was elected clerk of Sumter County, Ala., but the following year the law was changed and he was deprived of his office. At the same time, however, he was elected probate judge of the same county, serving in this capacity six years.
In 1856 he moved to Monroe County, Tenn., and in 1859 took up his residence in Fayetteville, Ark., for the purpose of educating his children. He had commenced the study of law in 1848, and the following year was admitted to the bar, practicing his profession in Fayetteville until 1880, when he became a citizen of Greenwood, Ark. Two years later he was elected judge of Sebastian County, being re-elected in 1884 and 1886. He has always rendered his decisions with judicial fairness, and has made a capable and popular public officer.
Previous to the late lamentable war he was a Whig in politics, but since that conflict has been a supporter of Democratic principles. He is a Royal Arch Mason, and a member of the Methodist Episcopal Church, South. His wife belongs to the Christian Church.

Sarah Johnson Inge prior to her marriage was a teacher and the following is an excerpt from an announcement of the beginning on the 1st day of March 1847, of the first session of THE LIVINGSTON FEMALE ACADEMY of Livingston, Sumter Co., Ala., which announcement was reprinted in the Mobile Press Register of Mobile, Ala., Sunday, December 14, 1969 in of interest.
The supervision of the institution in confided to Mrs. MARGARET McSHAN, a lady of known abilities and tested experience in governing and teaching. She will be assisted by Miss SARAH J. INGE, most favorably known to the patrons in Livingston, who can testify that none ever taught more correctly or advanced students more rapidly. March 2, 1847.

After several years he moved to Greenwood, Ark. and established a mercantile business of his own. In 1883 he formed a partnership with Thos. E. Little and the firm was named L & G. This company continued until December 1887 when the partnership was dissolved by mutual agreement and the firm became M. S. Gaines and Company. Their stock of merchandise was the largest in Greenwood and the business was successful. He was a Democrat; a member of the school board of Greenwood. for six years; a Master Mason; a K of H; and he and his wife were members of the Methodist Episcopal Church South. DURING HIS LONG ILLNESS AND WHILE HE WAS IN THE HOSPITAL AT OMAHA HE WAS
IN CONSTANT RECEIPT OF LETTERS FROM HIS MANY FRIENDS AND WAS VISITED BY A
NUMBER INCLUDING ONE OF HIS TEACHERS WHO CONSIDERED HIM SO PROMISING, SO
LOVABLE AND IDEAL AND WHO REPORTS THAT HE WAS SO DEEMED BY THE NURSES AND
ALL AT THE HOSPITAL.
HE LOVED ATHLETICS AND HIS STUDIES AS HELPFUL IN DEVELOPING STRENGTH OF
BODY AND MIND. FULL OF HOPE FOR THE FUTURE TO THE VERY LAST HE WAS
PLANNING FOR THE HIGHEST AND BEST AND NO ONE GAVE GREATER PROMISE FOR A
BRIGHT AND SUCCESSFUL LIFE. HE OFTEN CONSULTED THOSE WHOM HE DEEMED THE
BEST QUALIFIED TO ADVISE HIM AS TO A CHOSEN PROFESSION.
HE WAS SO APPRECIATIVE FOR EVERY KINDNESS SHOWN, SO UNASSUMING WHEN GIVEN
A PLACE OF HONOR, EVER SEEING THE GOOD IN OTHERS, OPTIMISTIC TO THE END,
PLANNING, TRUSTING, HOPING, BELIEVING; BUT THE INCURABLE MALADY
(LEUKEMIA) THAT HAD INFECTED HIS YOUTHFUL BODY SAPPED HIS VITALITY AND
THE UNFINISHED TASKS WILL BE CONSUMATED IN A MORE CONGENIAL REALM.
HE WAS A MODEL BOY IN EVERY WAY LOVED AND HONORED BY ALL WHO KNEW HIM AND
THOSE WHO KNEW HIM BEST LOVED HIM MOST. HE WAS AS TENDER-HEARTED AS
ABRAHAM LINCOLN IN HIS SOLICTOUS CARE OF INJURED BIRD OR BEAST. HE WAS
SO SIMPLE IN HIS WAYS AND LOVES THAT THERE ARE NONE WHO EVER SAW HIM DO
AN UNKIND ACT OR NOTED ANY LACK OF GRATITUDE FOR EVEN THE SMALLEST FAVOR
SHOWN. HE WILL BE MISSED HERE BUT HE WILL MAKE HEAVEN THAT MUCH RICHER.

GLADYS IONE HENRY WAS BORN TO ULRIC AND VERNA HENRY ON JULY 19, 1918, AT
GUIDE ROCK, NE. SHE PASSED AWAY JULY 6, 1949, IN GULFPORT, MISSISSIPPI,
AT THE AGE OF 30 YEAARS, 11 MONTHS AND 14 DAYS. HER ENTIRE LIFE WAS
SPENT IN GUIDE ROCK UNTIL HER MARRIAGE TO CARL WHITE ON FEBRUARY 15, 1938.
SHE WAS A MEMBER OF THE CHURCH OF CHRIST. SHE WORKED HARD EVERY DAY OF
HER LIFE FOR HER LORD AND HIS CHURCH. SHE WAS FAITHFUL UNTIL DEATH.
BECAUSE OF HER LIFE AND THE THINGS SHE DID, EVERYONE SPOKE WELL OF HER
AND KNEW THAT SHE WAS A CHRISTIAN.
JESUS SAID: "LET YOUR LIGHT SO SHINE BEFORE MEN THAT THEY MAY SEE YOUR
GOOD WORKS AND GLORIFY YOUR FATHER IN HEAVEN." THIS WAS TRUE IN IONE'S
LIFE. ALL WHO KNEW HER AND ASSOCIATED WITH HER WERE INFLUENCED BY HER
LIFE.
PRECEDING HER IN DEATH WERE A BABY SON ON JANUARY 20, 1939, AND HER
FATHER, ULRIC HENRY, WHO PASSED AWAY JUST THREE MONTHS AGO.
OF HER IMMEDIATE FAMILY SHE LEAVES TO MOURN HER PASSING HER HUSBAND, CARL
WHITE, TWO DAUGHTERS, KATHLEEN ANNE AND KAREN GLYN, HER MOTHER, MRS.
VERNA HENRY, TWO BROTHERS, GLEN AND NEIL, HER UNCLE, WIN HENRY AND A
GREAT NUMBER OF OTHER RELATIVES AND FRIENDS.
THE FUNERAL SERVICES WERE HELD SUNDAY AFTERNOON AT THE METHODIST CHURCH
IN GUIDE ROCK WITH SERMON BY REV. WARREN HOCKMAN.

A REPORT HAS BEEN RECEIVED IN THE HEADQUARTERS FROM OVERSEAS WHICHENABLES ME TO GIVE YOU SOME INFORMATION CONCERNING THE CIRCUMSTANCES ATTENDING THE DISAPPEARANCE OF YOUR SON, SERGEANT WILLIAM F. PAYNE, 1070176, U.S. MARINE CORPS.
ACCORDING TO THIS REPORT ON JULY 19, 1953, THE FIRST PLATOON OF COMPANY "G" OF WHICH YOUR SON WAS A MEMBER, HAD JUST OCCUPIED OUTPOST "EAST BERLIN" WHEN AT 10:00 P.M. IT WAS ATTACKED BY INTENSE MORTOR AND ARTILLERY BOMBARDMENT AND OVER RUN BY ENEMY TROOPS. WILLIAM AND PRIVATE FIRST CLASS TRAVIS L. RYAN, U.S. MAARINE CORPS, WERE IN PLATOON COMMAND POST BUNKER WHEN A BARRAGE OF ENEMY MORTOR FIRE LANDED ON IT CAVING IT IN AND PROHIBITING ENTRY OR EXIT.
THE FEW MARINES WHO COULD MOVE AFTER THE INITIAL BARRAGE AND ATTACK FOUND THEMSELVES COMPLETELY SURROUNDED BY ENEMY TROOPS. THEY WERE ABLE TO MUSTER THEMSELVES TOGETHER AND FIGHT THEIR WAY OUT TO THE MAIN LINE OF RESISTANCE; HOWEVER THE INTENSE COMBAT SITUATION DID NOT PERMIT THEM TO REMOVE THEIR DEAD OR WOUNDED COMRADES.
WHILE I MUST REGRETFULLY EMPHASIZE THE FACT THAT YOUR SON MAY BE DEAD, THE REPORT FROM HIS ORGANIZATION DOES NOT CONTAIN SUFFICIENT EVIDENCE TO WARRANT A CONCLUSIVE DETERMINATION OF DEATH. HE WILL CONTINUE TO BE CARRIED ON THE ROLLS OF THIS HEADQUARTERS AS MISSING IN ACTION.
