IN THE NAME OF GOD AMEN: I, Dan'lPughoftheCo.ofHamps.Va.,beingweakinbodybut ofsoundmindandmemory,BlessedbeAlmightyGodfor thesame,domakeandpublishthismylastwillandtestamentinmanner andformfollowing:
First: I give and bequeath to mybelovedwife,SarahPugh,thesumofthreehundredpoundscurrentmoney,moneytobepaidherbymyExecutors,hereafternamed,withinfiveyearsaftermydecease,orsoonerifthesituation of myestatewilladmit,butitismywillthatshereceive nopartofsaidlegacyuntilshehasreleasedherrightofdowerin all andto my landsofwhichshemaybedowableas mywife.
Item - I give and devise to my sonHannibalPughtwotractsoflandinHarrisonCo.Viz:OneofSevenHundredandNinety.A.beingonMaxwell'sRun,theotheroftwenty-fiveA.,adjoiningthetownofClarksburg,tohimandhisheirsforever. Idevisethatallmyotherlandsofwhateverdescriptionandwhetherclaimedorheldbydeedsurvey,entry,or inanyother manner,maybesoldbymyExecutors(iftheyfinditnecessary) forthepay'tofmyjustdebtsandthelegacyaforesaidtomywife, orsuchcreditsastheymayjudgeproper,andafter mydebtsandthelegacy tomywifearedischargedanddisposedof--theresidueofmylands (ifanyremainunsold)One-halfIdevisetomysonHannibalPughandthe otherhalftomydaughters,AmyandJulianaPughtobeequallydividedbetweentheminquantityandqualitytothem,mysaidsonanddaughters,andtheirheirsandassignsforever--butifnolandsshouldremainunsold,thentheresidueofthemoneyarisingfromthesale ofmysaidlandsandallmyoutstandingdebtswhenrecovered,IgiveandbequeathtomysonanddaughtersasaforesaidandinlikeproportionsandwhereasIhavebroughtsuitintheDistrictCourtheldatWinchesteragainstacertainJamesParsonsforfivenegroes,Viz:Sambo,Rachel(DaughterofHannah)Tes,Sarah,andRachel(Daughter ofBarl)anditismydesirethatthenegroesifrecoveredshouldremaintomychildren,IthereforegiveanddisposeoftheminthefollowingmannerViz:SamboandRachel(DaughterofHannah)IbequeathtomysonHannibal,Rachel(DaughterofBarl)tomydaughterAmy,andTestomydaughter, Juliana--Tothemandtheirheirsforever--andwhereasIaminformedthatIcannotrecoverSarah(thesaidParsonshavingsoldher)butonlyacompensationindamages--Itis,therefore,mydesirethatthatcompensationbeequallydividedbetweenmydaughtersAmyandJuliana.
All the rest residue and remainderofmyestateofwhateverkindIgiveandbequeathone-halftomysonHannibal,andtheotherhalftomydaughtersAmyandJuliana,tobeequallydividedbetweenthem.
To my executors I devise the custodyandtuitionofmychildren,requestingthemtohavemydaughtersbroughtupandeducatedina mannersuitabletotheirsexandfortune,andtohavemysoneducatedliberally,ifhediscoverstalentsworthyofmuchcultivation,otherwisetohavehimeducatedinamanneradaptedtothecommonbusiness oflife.
Lastly, I do hereby constitute andappointmytrustyfriends,IsaacParsons,JonathanParsons,HezakiahDavissonandJohnPrunty,Executorsofthis,mylastWillandTestament,andrevokeallformer willsmadebymeinwritings,whereofIhavehereuntosetmyhandand seal this26th dayofMay,intheyear ofourLord,1794.
